Questions and Answers from our recent HOA Q & A meeting held on July 17th 2024.

Question from Donna / Breakwater Lane – What are the hours that the fountain in the pond should be running? Sometimes it runs 24 hours.
Answer – The hours should be 8am -10pm. The Board will communicate with our vendor (Aquatic) to confirm the timing.
Question from Frank / Kennebunk Lane – Why are there brown circles on his lawn? He spoke with Red Bud employee, and they told him it was “summer patch”. Frank is concerned that it may be a fungus that could spread throughout the subdivision.
Answer – The Board acknowledged the question, looked at Frank’s photos, and agreed that this is a problem. After the meeting — The Board came out to view the lawn and sent a detailed email to Red Bud seeking answers.
Question from Linda/ Breakwater Lane – Did we change our fertilizer company? There seems to be a lot of weeds.
Answer – Yes, the previous Board changed our fertilizer company. Red Bud is now fertilizing (5 times per season). It was cost effective to switch companies. The Board will discuss this weed issue with Red Bud.
Suggestion from Deb/ Breakwater Lane – Please ask Red Bud not to fertilize on the same day that they cut the grass.
Answer– Yes, the Board will do that.
Question from Debbie/ Breakwater Lane- Her light pole is not secured properly in the ground, and her front tree is dying.
Answer – The trees in front of the homeowner’s house is their responsibility, not the Board’s. If the homeowner would like to plant a new tree, please fill out the “Application for Exterior Improvements” form on the website. New front trees planted should be in the Maple family. There was also a discussion about trying to keep the tree alive.
The issue about the light pole – The Board suggested possibly speaking to McFarland regarding a solution. Board will follow up with homeowner.
Question from Debbie K / Hateras Lane- She just closed on her new home, but did not receive anything from the HOA with the covenants, etc. She also mentioned that we did not have a “Welcome Committee” to welcome her to the neighborhood.
Answer – The Board apologized that she did not receive her covenants – that is usually given to a new homeowner at the closing by the Realtor. Our covenants are on the website to easily access. The Board also acknowledged that we do not have a “Welcome Committee” – but thought it is a good idea to have one, and will be asking residents if anyone is interested in helping out with that.
Question from Carol / Nantucket Drive – She just moved in and was wondering why she did not get her covenants at closing.
Answer– The Board apologized that she did not receive her covenants – that is usually given to a new homeowner at the closing by the Realtor. Our covenants are on the website to easily access.
Question from David / Breakwater Lane – How are we paying for snow removal? Are we paying for it when we don’t need it?
Answer – We pay for snow removal only when the company comes out to plow (over 2 inches). We do budget for an “average” snow fall per year. We have been fortunate the past 2 years with light snow. We have taken the unused funds and put them into a contingent savings account.
Question from Karen / Breakwater Lane – Why are the sprinklers on so many days; even when it’s raining?
Answer – The Board has discussed purchasing a water sensor to add to the irrigation. We have discovered that it is very expensive and not always accurate. The sprinkler schedule is for 3 days a week (Monday, Thursday, Saturday).
Question from Deb/ Breakwater Lane – Why are our dues higher than some other local subdivisions?
Answer- When the builder handed the subdivision over to the homeowners a couple of years ago, we were informed that the builder had been supplementing somewhere around $70K towards our vendor fees. The previous Board had no choice but to increase our dues. Your current Board is working extremely hard to reduce vendor costs by finding quotes from new vendors.
Question from Donna / Breakwater Lane – Can we start the sprinklers later in the year next spring? Can she turn it off when she wants to?
Answer – Your Board will speak with the irrigation company about the best start date & see how cost efficient a later start date would be. The Board cannot say that individual homeowners can turn off the sprinklers when they decide to, as it affects several lawns.
Question from Janet / Nantucket Drive – Why are sprinklers coming on an extra day by her home?
Answer – Rainmaker has already been made aware of this situation, told to change it, and we are keeping an eye on it. The Board also addressed the water bill from Cedar Lake noting the days of the week to water lawns.
Question from Larry/ Breakwater Lane – A lot of people who do not live here are fishing in our pond. Can we put out signs that say “No Trespassing”?
Answer – We will get quotes for signs to be made… Signs to say: Private Property – Residents Only.
Question from Joyce/ Hateras Lane – What is considered HOA pond property? Can we as residents walk by the pond?
Answer – Yes, residents can walk by and around the pond. There are easement areas to get there, so you can avoid walking on individual homeowner’s property.
Question from Patty/ Breakwater Lane – What is the Board doing about people who are not paying their dues?
Answer– Up to this point, we have not had that problem. One resident was having some problems paying, and she is now making monthly payments.
Comment from Gene/ Breakwater Lane – The covenants state that spouses cannot be on the Board at the same time.
Answer – The Board was unaware of that and our attorney told us that it was OK when we appointed the current President. We will discuss this issue with our attorney.
Question fro Deb / Breakwater Lane – What constitutes a “nuisance”? Our by-laws make it clear that a nuisance is a violation.
Answer – A nuisance is subjective- therefore it is up to the Board / ARC to determine if the nuisance complaint meets the “Common Man Standard” nuisance.
